Fred Smith Lawsuit Heads To Court Thursday

The effort to get a state house candidate off May's ballot hits the courthouse Thursday.

The Pulaski County Circuit Court will hear a lawsuit filed by the Arkansas Democratic Party that asks to remove State House Candidate Fred Smith, a democrat, from the May 22 ballot. The lawsuit says he doesn't qualify to run because he has been convicted of theft.

Back in 2010, Smith resigned from his District 50 seat after being found guilty of theft of property delivered by mistake. His conviction has since been dismissed.
