A co-author of the song "Eye of the Tiger" is suing Newt Gingrich to get him to stop playing it at his campaign events.

Rude Music Incorporated, owned by Frank Sullivan of the band Survivor, filed the lawsuit in federal court in Chicago Monday.

The 1982 song graced the "Rocky Three" soundtrack, became a number one hit, earned a Grammy and was nominated for an Oscar.

The suit alleges Gingrich has been using it at events since around 2009, without permission. He used it at this event in Des Moines earlier this month.

The lawsuit seeks an injunction to block him from using it again, plus damages and lawyer fees.

There's no response yet from the Gingrich campaign.
