LITTLE ROCK, AR--  A Ouachita County capital murder suspect is out of jail, now the victim's family wants to know why.

Deputies arrested Clyde Sumler in December in connection with the murder of Brenda Thrower. But prosecutors haven't filed formal charges.

Dollie Golden misses her niece.

"This has been devastating to the family and the community," said Golden.

On December 15 in Harmony Grove, investigators found the 47-year-old Thrower inside her burning home dead.

Sumler was arrested. Golden says he was Brenda's boyfriend and father of her four sons.

The prosecuting attorney says he is waiting on more evidence from investigators before filing formal charges. Without charges, state law only allows deputies to hold Sumler for 60 days. So they had to release him from jail.

"We are hurting. We lost someone that we loved and care for very dearly," said Golden.

She hopes the charges aren't dropped.

Prosecutors say they hope to make a decision within the next 60 days about the case.
