The Arkansas Attorney General's office Tuesday told the Supreme Court the Searcy County Sheriff should be out of a job.

In a brief, an attorney says Sheriff Kenney Cassell is not qualified to hold office under the Arkansas Constitution because he was convicted of theft in 1979.

A lower court judge previously said he was qualified, because the crime was only a misdemeanor.

Now the Supreme Court must decide whether to hear the case.
