Faulkner Co. Administrator Due in Court on Wednesday

The second in command of Faulkner County will ask a judge to drop theft charges against him on Wednesday.

In court documents, County Administrator Jeff Johnston's attorney argues that a warrant wasn't filed according to the law, but the prosecutor disagrees.

Johnston is charged with theft after prosecutors say he took $4,000 worth of county-owned asphalt to pave his own driveway.
