Patricia Cannaday had asked the justices to review a Circuit Court decision that dismissed the case, holding that an invasion of privacy and outrages claim didn't survive Pressly's death.
The lower court had also ruled that St. Vincent Infirmary, where Pressly's medical records were improperly examined, couldn't be held vicariously liable.
The Supreme Court agreed on the first point, that the invasion of privacy claim didn't survive. However, it ordered more hearings on the claim of emotional distress by her mother, along with the claim that the hospital could be held liable for its employees actions.
