In an advisory issued to media on Tuesday, Nancy Todd, representing the casino amendment proposed for the November 6, 2012 ballot, says she will be turning in her additional signatures at 1 p.m. Wednesday, Aug. 22.
Original Story:
In a statement issued on Monday, Nancy Todd stated she has refiled the proposed Ballot Title language with the Secretary of State's office addressing their concern.
"We didn't see the language as affecting the tracks in any manner, but they did, and they stated a compelling enough of an argument to the Secretary of State that both he and Attorney General McDaniel agreed with them. I must respect their collective opinions and have changed the language to address what they believe to be a supposed ambiguity."
Late Thursday afternoon Todd refiled the proposed Ballot Title language which she believes completely addresses the issue.
By adding the following language -" Such prohibition may repeal the Electronic Games of Skill Act, and thereby prohibit Oaklawn Racing and Southland Racing from continuing to operate electronic games of skill at their respective race tracks in Hot Springs and West Memphis" -- to the Ballot Title, Todd believes we have cured the deficiency as allowed by the Arkansas Constitution.
"We've asked the Honorable Secretary of State Martin to accept this language and declare this corrected Ballot Title to be fair and complete and certify the measure to the County Board of Election Commissioners of each County in the State pursuant to A.C.A. 7-5-204." Todd stated.
"We know he is allowed up to 15 days to make such a decision but due to time being of the essence, we have respectfully requested he make an immediate determination on this issue." In conclusion Todd stated: "I know the Secretary of State will make the right decision. We have cured the alleged deficiency and can now move toward our original goal and that is to let the voters in Arkansas decide this important issue on November 6th."
