Updated: January 7, 2009
Jefferson County Circuit Judge Fred Davis III spent Tuesday on the other side of the bench, accused of tax evasion charges. Davis was stopped last year in Hot Springs on suspicion of driving while intoxicated. During that stop, officers noticed a dealer plate on his 2002 Avalanche. The vehicle hasnt been registered since the year of its purchase. Davis defense attorney says he was unfairly targeted. "There have been thousands of other people been late paying their taxes," said Charles Sidney Gibson, who represents Davis. "This has never happened to them so we believe he`s being picked out because he was a judge." Special Prosecutor Henry Morgan denies the charges. "We`re not doing that here," said Morgan. "It`s just a law in Arkansas and when we found out about it, we prosecuted." Morgan says Davis was warned repeatedly throughout 2004 to register his vehicle and didnt. Davis received a DWI conviction in Hot Springs and is appealing the verdict
