State Supreme Court Takes Away Sentence Of Admitted Rapist

The state Supreme Court is wiping out the jail sentence of a convicted rapist. Thursday, the court ruled that Michael Shane Jolly was not given a speedy sentencing. Jolly, who is now 27, pleaded guilty in Saline County Circuit Court in October of 1997 to having consensual sex with a twelve-year-old girl. But the court and former Saline County Prosecutor Barbara Webb lost track of the case before Jolly could be sentenced and he went about his life in Saline County for six years. The state noticed the case was still open when Robert Herzfeld replaced Webb as prosecutor in January of last year. Circuit Court Judge Grisham Phillips finally sentenced Jolly last August to 12 years in prison with 12 years suspended.
