A Pulaski County circuit judge has dismissed
a Little Rock resident`s claims against a bank handling bonds
issued by the city to pay for park improvements. Nora Harris had
sued Metropolitan National Bank and the city, saying that the way
money was used to pay for the parks was inappropriate. She argued
that the city should have held an election before using any of the
bond money for land on which the Clinton Presidential Library is
being built.
Beth Deere, lawyer for the bank, said Harris misintpreted
Amendment 65 to the state Constitution. Deere said that amendment
explicitly allows cities to borrow money without an election by
issuing general revenue bonds. Other state laws prohibit from
issuing bonds backed by tax revenues, and Harris had argued that
those rules applied.
After a hearing this morning, the suit was dismissed by Circuit
Judge Collins Kilgore.
