Tax Lawsuit Dropped Involving K-Mart And Arkansas

A federal judge in Chicago has dismissed a lawsuit filed by Kmart that claimed hundreds of towns, cities and counties nationwide overcharged the discount retailer millions of dollars in property taxes. Arkansas was among the states with communities named in the court action. Judge Jack Schmetterer ruled that Kmart failed to explain why the U-S Bankruptcy Court would have jurisdiction in the case. But Schmetterer left the door open for Kmart to refile the suit. The suit was filed May fifth, the day before Kmart emerged from 15 months of bankruptcy protection. The lawsuit asked the court to lower 2001 and 2002 tax assessments, claiming decisions by assessors overstated the value of Kmart stores and other facilities. ------ In addition to Arkansas, states with communities named in the suit included Alabama, Alaska, California, Colorado, Connecticut, Georgia, Idaho, Kansas, Louisiana, Michigan, Missouri, Mississippi, Montana, Nevada, New Mexico, North Carolina, Oklahoma, Oregon, Rhode Island, Tennessee, Texas, Washington, Wisconsin and Wyoming
