Prosecutor Larry Jegley has dropped his suit to remove Pulaski County Clerk Carolyn Staley from office. He made the decision after Staley did not file for re-election by the deadline earlier this week.
Circuit Judge Marion Humphrey dismissed the suit today at Jegley`s request. The suit could be filed again later, but Jegley doesn`t think that`s likely.
Jegley said that appeals of any decision would probably have delayed any final resolution of the case until 2005, more than a year after Staley leaves office on January First.
The prosecutor filed the suit to remove Staley after a special grand jury issued a report in December strongly critical of Staley that recommended her removal.
