A Jefferson County sheriff`s deputy who was
charged with Sheriff Boe Fontaine for allegedly failing to promptly
shut down a gambling house says the state can`t remove him from
office.
Dane Reed`s attorney filed a motion in Jefferson County Circuit
Court yesterday says the charge should be dismissed because it
gives the state power to remove a local official.
Reed is arguing that the state Constitution allows local
officials to be removed only upon conviction in circuit court.
Reed and Fontaine are charged with breaking an old state law
that requires authorities to arrest suspected operators of gambling
houses as soon as they hear about them.
