Arkansas Supreme Court Upholds Murder Conviction

A man`s capital murder conviction for killing a woman and burning her body is being upheld by the state Supreme Court. The court ruled that although a gun unrelated to the killing was admitted into evidence, the error was NOT enough to unfairly prejudice jurors. The court says there is a great deal of evidence that Roger Dale Barrett killed Eunice Bradley. A firearm found in Barrett`s house was introduced as evidence even though it was NOT the murder weapon. Prosecutors argued that the actual murder weapon was never found, so the presence of other weapons at his home showed that Barrett tried to cover up elements of his crime by disposing of the gun used in the crime. In a dissenting opinion, two justices argued that the prosecution deliberately tried to prejudice the jury by introducing the gun and Barrett should have a new trial. Posted by Mike Hellgren
