An Arkansas woman who was court ordered to pay back $1 million dollars in lottery winnings from a ticket that she found in the trash is heading back to court.

This time Sharon Jones' fortunes could change.

White County Circuit Judge Thomas Hughes originally ruled Sharon Duncan, the woman who bought that ticket, should get the winnings.

Now Hughes has changed his mind and is calling for a new trial.

Jones' attorney said he thinks they will win this time.

"I'm confident we will prevail. I believe the law is on our side," said Jimmy Simpson, Jones' attorney.

The lawsuit made national news. Jones and Simpson appeared on NBC's Today Show.

Jones had spent more than half of the winnings and weeks ago was struggling to figure out how she was going to pay Duncan.

The attorney for Duncan did not return our calls seeking comment.

Simpson said this case is out of the norm.

"There's just not another case like it out there," Simpson said.

A new court date has not yet been set.
