Judge Rules On Gay Foster Parents

A PULASKI COUNTY JUDGE HANDED DOWN A MAJOR DECISION THIS AFTERNOON, CONCERNING GAY FOSTER PARENTS. HE RULED ITS UNCONSTITUTIONAL. EARLIER THIS MONTH - FINAL TESTIMONY WAS PRESENTED IN THE CASE. THE AMERICAN CIVIL LIBERTIES UNION FILED SUIT AGAINST THE CHILD WELFARE AGENCY REVIEW BOARD IN HOPES OF DOING AWAY WITH THE 1999 BAN. JUDGE TIMOTHY FOX RULED THE BAN DISCRIMINATED AGAINST SAME SEX COUPLES. THE A-C-L-U SAYS THIS RULING IS A VICTORY FOR FOSTER CHILDREN ACROSS THE STATE. A SPOKESPERSON FOR FOR THE DEPARTMENT OF HUMAN SERVICES SAYS THEY`RE PLEASED THAT THE JUDGE FOUND THE BAN DIDN`T VIOLATE EQUAL PROTECTION OR PRIVACY. D-H-S ATTORNEYS PLAN TO APPEAL THE RULING.
