Richard Conte, 61, is to be charged with a 2002 double murder in Conway.
The victims were Carter Elliott, 48, and Timothy Robinson, 25.
The charges against Conte were filed this morning by Cody Hiland, 20th Judicial District Prosecuting Attorney.
Conte is currently in jail in Nevada and scheduled to be released Sunday. He served nine years of a 15-year sentence stemming from the kidnapping of his ex-wife Lark Gathright-Elliott, who was also the ex-wife of Carter Elliott.
While Conte was scheduled to be released in two days, he will be held on a warrant for two counts of capital murder.
"We've felt all along that there was enough evidence to warrant charges, but it's up to the prosecutor to make the final decision. We can't speak for previous prosecutors as to why charges weren't filed earlier," said Conway Police Chief A.J. Gary.
