The Arkansas Attorney General`s office and the Saline County prosecutor say they will appeal the case of convicted rapist set free after a six-year delay in his sentencing to the Supreme Court.
Michael Shane Jolly`s conviction was overturned by the state Supreme Court in June. In a 5-2 ruling the court said the delay in sentencing violated his right to a speedy trial. Jolly pleaded
guilty in Saline County Circuit Court in 1997, to having consensual sex with a 12-year-old girl. But former Saline County Prosecutor Barbara Webb apparently lost track of the case and Jolly was not sentenced. Current Saline County Prosecutor Robert Herzfeld discovered the error and ordered Jolly imprisoned.
