Rest Stop Risk?

A day after a murder victim`s responsibility to presume risk at a rest stop is part of the reason her family`s claim against the state is denied...... thousands of people are driving to spend Easter with their families. KARK 4 News asked drivers if they ever consider they may be taking their lives in their hands when they pull into a rest stop. "No. I don`t think of that. I never look around to see who the other people there may be, who`s sleeping in a car overnight, " said Sally Johnson of Cincinatti, OH. She and her husband Bob travel all over the country and always pull into rest stops. This weekend they`re headed to Kirbysville, Texas to visit their daughter. The Johnsons say you presume some kind of risk even when you walk out of your home, but that people expect a rest stop to be monitored and safe. In August of 2000 Kristin Laurite was stabbed and raped at the Morrillton rest stop. The area had been slated for closure, but was kept open with a new security camera feature. Those cameras were not working when Kristin was killed. Her family believes the state`s responsible because of its negligence in maintaining the rest stop. For the state to have been found liable, a higher standard of maliciousness would have had to have been proven.
