Four parents of children in the Conway School
District have refiled a lawsuit that challenges the district`s
drug-testing policy. They claim the tests are unconstitutional and
invade students` privacy.
The parents had filed suit in 2002, but the court action was
dismissed in January 2003. Two months later, the judge ruled that
the Faulkner County Circuit Court case could continue.
The district has been administering drug tests to students in
extracurricular activities. The lawsuit claims the random drug
tests violate the state constitution and the equal protection
clause of the US Constitution. In refiling the case, the parents
also cite a 2002 Arkansas Supreme Court ruling that overturned the
state`s sodomy law.
In that case, the high court ruled the law unconstitutional on
grounds it infringed on the right to privacy and equal protection.
The district says it has no plans to change its policy.
