Supreme Court To Hear Lakeview Arguments

Throughout state government, uneasy officials are bracing for the response of Arkansas` highest court to the state`s failure to meet a deadline for overhauling the state`s education system. The state Supreme Court is scheduled to hear arguments tomorrow. The court is considering a motion to cut the flow of money to most state agencies until the Legislature complies with a court order to change a school funding formula the court unanimously declared unconstitutional in November 2002. Despite a four-month regular session last year and a continuing special session, the state missed a court-imposed January first deadline for developing a system that provides equal educational opportunities for all of Arkansas` school children. Governor Huckabee says he is nervous about what the court may say. Huckabee criticized the Legislature for a lack of progress and says he hopes the court will embrace his idea of the executive and judicial branches working in concert to carry out the court`s mandate through the state Department of Education and state Board of Education.
