A new federal regulation tentatively adopted
today in Washington has already stirred old debates in Arkansas.
The measure would allow cities to silence train whistles as long
as certain safety measures are met -- a move considered by the
Arkansas Legislature in 2001.
Two years ago, the state House passed a bill to create "quiet
zones" where passing trains would NOT be allowed to blow their
whistles. But the measure was soundly defeated in the state Senate
because of safety concerns.
If the new Federal Railroad Administration regulation is
affirmed after a public comment period, it would take effect
December 18th, 2004, and supersede existing state laws.
For the first time, cities across the country will be able to
set up quiet zones if they have flashing lights and gates at all
crossings and make other improvements.
