Accused Drunken Driver Who Hit Motorcyclist Was Repeat Offender

The man accused of causing so much heartache to the loved ones of Trevor Ware, according to court documents, had killed someone by driving under the influence.

Yet he still managed to get behind the wheel, and destroy another life.

Simply throwing a ball is difficult for Trevor, but it's when he grabs a marker you can see the  determination his family said was such a big part of who he was before the accident.

"It's his birthday," said Trevor's mother Pamela Ware, "He's 29 years old today. "

It's a  far cry from how he spent his 28th birthday, blowing out candles, taking in a concert,  always, his family said,  living life to the fullest.

"It's a hard day."

Trevor's mother spent most of his 29th birthday in the same room as the person accused of leaving him in this condition.

Having to face Nathan Ray at his first court appearance.

Ray's accused of hitting Trevor, who was on a motorcycle, and then leaving the victim on the highway.

"It's incredibly frustrating," said Pamela Ware. "I'm learning a lot of about how the legal system works and how it deals with DWIs."

Frustrating because she said Ray has done this before.

According to court documents, Ray was given probation in Indiana, after being found guilty of killing someone while drinking and driving.

"It made me realize this isn't just about Trevor," she said. "I want to raise awareness for everyone."

She said she owes it to her son who is missing out on so much.

"All the family holidays coming up he won't be participating in," she said, "It's difficult."

A much different birthday celebration this year, spent quietly with the people who care about him most.

Ray has remained in custody since the September accident.

He was issued a continuance this afternoon on his charges of driving while intoxicated, refusing to submit, no insurance and unsafe driving.
